Keep Current With Spousal Support Laws

Changes to Illinois spousal support laws do not always happen on a yearly basis, but when changes do happen, you need to be sure how they impact your spousal support order. What Is New In 2019?

In 2019, Illinois courts changed the tax treatment of spousal support payments. In past years, the tax burden of these payments was on the payor. Now, the burden is on the recipient. This means that the payor cannot deduct their payments from their taxes anymore.

Calculations of spousal maintenance have also been adapted in 2019. The courts previously determined the value of spousal maintenance by subtracting the value of 20 percent of the recipient’s gross income from 30 percent of the payor’s gross income. Those figures have changed to 25 percent of the recipient’s net income and 33.33 percent of the payor’s net income.
